On the heels of several years of increasingly strict employment eligibility verification enforcement, the government has recently increased fines for Form I-9 violations, making it more critical than ever that employers exercise compliant hiring practices.

Penalties for Form I-9 infractions have increased, effective August 1, 2016. There are two types of violations that will be punished more harshly: (1) the employment of individuals who are not authorized to work in the U.S. and (2) Form I-9 paperwork errors. The adjustment, a federal mandate in response to inflation, will result in an increase in fines anywhere between 35 percent and 96 percent, depending on the infraction.

According to Farrell, “If large and small enterprises had HR and IT systems in place to ensure legislative compliance obligations were met, they would spend less time on mundane tasks like employment eligibility verifications, I-9s, HIPAA and PCI compliance, and certification and training requirements.”

He added that more time could be devoted to “Human Capital” mandates such as leadership building, mentoring and talent evaluation.
